JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 364(A) of the Indian Penal Code.

Petitioner is in jail custody since the year 2013 and the F.I.R. of Bagaha P.S. Case No. 488 of 2013 goes to show that petitioner voluntarily surrendered before the police and produced arms and ammunitions. No doubt, petitioner happens to be a dreaded criminal but he surrendered before the Administration with an intent to join the mainstream of the society. So far as present case is concerned, the name of petitioner came in

Patna High Court Cr.Misc. No.49277 of 2016 (4) dt.29-03-2017 2/2 confessional statement of co-accused and taking note of the aforesaid fact the prayer for bail of the petitioner was earlier rejected by this court vide order dated 09.03.2016 passed in Cr. Misc. No. 1939 of 2016 directing the trial court to expedite the trial of the petitioner and to conclude the same as early as possible, preferably within six months.

The learned trial court has reported that up till now, not a single prosecution witness could be examined on behalf of the prosecution.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that having more or less similar allegation, several co-accused have already been granted privilege of bail by other Benches of this court, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Bagaha, West Champaran in connection with Sessions Trial No. 15 of 2014 arising out of Naurangia P.S.
