JUSTICE SUDHIR SINGH ORAL ORDER 21-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 302/34 of the Indian Penal Code and 27 of Arms Act.. The allegation against the petitioner and other coaccused is of killing the brother of the informant by fire arm. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.12.2015. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the FIR. Merely on suspicion the petitioner has falsely been implicated in the present case.

On behalf of the State, it has been submitted that the petitioner is not named in the FIR.

No.45862 of 2016 (2) dt.21-10-2016 2/2 Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1,Siwan, in connection with Siwan Muffasil (Mahadeva) P.S.Case No.138 of 2013 (S.Tr. no.254 of 2016).
