Mr.Murli Dhar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 29-04-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners apprehend their arrest in connection with Tekari P.S. Case No. 307 of 2024 instituted under Sections 76, 115(2), 118(1), 303(2), 332, 351(2), 351(3), 3(5), 352 of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, co-accused namely Jay Prakash Yadav entered into the house of the informant and misbehaved with her and when she resisted, petitioners came there and assaulted the informant, her mother-in-law and other persons who tried to save them.

4. Learned counsel for the petitioners submits that the

Both parties are gotiyas and there is land dispute between them. The injury caused to the injured are simple in nature caused by hard and blunt substance. The petitioners have no criminal antecedent and they undertake to cooperate in the investigation and the trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIth, Gaya in connection with Tekari P.S. Case No. 307 of 2024, subject to the conditions as laid down in Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
