JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This application, for grant of anticipatory bail, arises out of Ramgarh P.S. Case No. 16 of 2019, disclosing offences under Sections 149, 452, 332, 333, 435, 436, 337, 338, 323, 324, 224, 225, 307, 153(A), 342, 224, 225, 307, 153(A), 342, 160, 379, 120-B, 353 of the Indian Penal Code. Petitioner case is that a mob of about 500 persons attacked the police station and ransack the same and also set the vehicles on fire and petitioner is named in the F.I.R. Submission of learned counsel for the petitioner is that as a matter of fact the sister of the informant was raped and killed and police was not lodging the case and as such, they were protesting against the police but the police has falsely implicated the petitioner in this case. Further submission is that co-accused having similar allegation has already been granted
Patna High Court CR. MISC. No.18991 of 2019(2) dt.07-05-2019 2/2 the privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 04.04.2019 passed in Cr. Misc. No. 21142 of 2019 and vide order dated 19.04.2019 passed in Cr. Misc. No. 24299 of 2019.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Ramgarh P.S. Case No. 16 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
