JUSTICE RAKESH KUMAR ORAL ORDER 21-01-2015 The present petition was initiated on the basis of an application filed by one Niva Devi with a prayer for transferring the Divorce Case No. 14 of 2012 pending in the court of Additional District Judge, Banka.
This matter was firstly taken up on 22nd July 2014 and on the same day notice was directed to be issued. However, subsequently, learned counsel for opposite party namely, Sri Rajesh Kumar appeared and informed that the case, which has been sought for its transfer has already been finally disposed of by the judgment dated 6th June, 2014. Subsequently, this court summoned the record from the court below, which has been received. On perusal of the record it is evident that Matrimonial Case No. 14 of 2012 regarding which transfer was sought for has already been disposed of on 6th June, 2014. Accordingly, the present matter has become infructuous. No positive order is
