JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Bihar Mahila P.S. Case No. 125 of 2016 instituted for the offence under Sections-498A, 406, 34 of the Indian Penal Code.
It has been submitted on behalf of petitioner that in the mediation centre, the matter has amicably been settled. The wife has agreed for one time settlement after receiving an amount of Rs. 1,50,000/- which has already been paid by the petitioner to the wife (opposite party No. 2).
Counsel for the opposite party No. 2 has appeared and submitted that money has already been paid by the petitioner to the wife opposite party No. 2.
In such circumstances, prayer for anticipatory bail is
Patna High Court Cr.Misc. No.14036 of 2017 (5) dt.06-10-2017 2/2 allowed and it is ordered that the petitioner named above in the event of his arrest or surrender in the court below within six weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with in Bihar Mahila P.S. Case No. 125 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Nalanda at Bihar Sharif subject to condition as laid down u/S 438(2) of the Cr.P.C.
The opposite party No. 2 will take proper steps for filing compromise petition in terms of agreement arrived at between the parties in all the cases filed by her against the petitioner. The petitioner will also take necessary steps for filing compromise petition in the case filed by him against opposite party No. 2.
