JUSTICE BIRENDRA KUMAR ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in Bhagwan Bazar P.S.Case No.257/16 registered for the offence punishable under Section 47 of the Bihar Excise Act.

About 10 liters of country made liquor was recovered from the possession of this petitioner. Submission of the petitioner is that he is in custody since 9.9.2016 and has stated on oath that he has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like

Patna High Court Cr.Misc. No.55301 of 2016 (2) dt.22-12-2016 2/2 amount each to the satisfaction of the C.J.M., Saran at Chapra, in Bhagwan Bazar P.S.Case No.257/16 corresponding to G.R.No.5817/16.
