====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 11-07-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 447, 448, 385, 387, 307, 427, 379 and 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and submits that informant is Project Manager of Progressive Construction Company alleges that on account of non-payment of extortion of Rs. 5,00,000/-, three named accused persons including the petitioners along with 10-15 unknown accused came and assaulted him, further petitioner no. 1 along with Jitendra assaulted Ram
Patna High Court CR. MISC. No.22135 of 2023(2) dt.11-07-2023 2/3 Kumar Singh with lathi and danda causing injury on head, thereafter accused persons also assaulted Madhav and damaged vehicles, machines and fled with two motorcycles. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that from the side of the petitioners also Harsidhi P.S. Case No. 514 of 2022 has been instituted wherein it has been alleged that the informant and their men who were involved in construction of road used to park their car in the high school and middle school near a Devisthan and used to pass lewd comments on girls which irritated the villagers on account of which the present occurrence took place. The learned counsel further submits that there is a case and a counter case and no stolen property has been recovered from the house of any of the petitioners and the injury suffered is simple in nature. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-
Patna High Court CR. MISC. No.22135 of 2023(2) dt.11-07-2023 3/3 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Harsidhi P.S. Case No. 513 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
