Learned counsel for the petitioners submits that the case Asarganj P.S. Case No. 56/2013 of petitioner no. 3 filed under Sections 498A and 34 of the Indian Penal Code and on the same and similar facts the wife of petitioner no. 3 filed complaint case in the court of Chief Judicial Magistrate, Saharsa bearing Complaint case No. 3796/2015.

Learned counsel for the petitioners seeks permission to withdraw this petition, so that the petitioner may file a petition under Section 210 of Cr. P.C. for staying the proceeding of the complaint case.

Patna High Court Cr.Misc. No.10330 of 2017 (2) dt.27-03-2017 Prayer is allowed. This quashing petition is dismissed as withdrawn.
