2. The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 420, 323, 341 of the Indian Penal Code.

3. As per the prosecution case, on 23.03.2023, informant gave Rs. 50,000/- to co-accused Prashant Kumar and when informant demanded his money, he (Prashant Kumar) refused to return the same and also abused & assaulted him. It is further alleged that on 25.12.2023, this petitioner tried to snatch the key of motorcycle of informant and when informant denied to give him key, this petitioner assaulted him.

4. Learned counsel for the petitioner submits that petitioner is co-villager of the informant and has been falsely

He further submits that from perusal of F.I.R., it is apparent that it was co-accused Prashant Kumar, who refused to return the alleged money to informant. Petitioner has got no concern with the alleged money transaction and as such, there was no occasion for this petitioner to commit the alleged offence. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Khagaria P.S. Case No. 01 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay U T
