JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioners and the State. The petitioner is apprehending his arrest in Ben P.S.Case No.156 of 2013 instituted under Sections 419, 420, 467, 468 and 471/34 of the Indian Penal Code pending in the Court of CJM, Nalanda.
It is alleged by the informant that petitioner is an accomplice in the offence of forgery and defalcation of public money by forging cheque and withdrawal of public fund. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is no specific allegation against him. Petitioner is an assistant to Rojgar Sewak.
On behalf of the State, it has been submitted that the
Patna High Court Cr.Misc. No.39404 of 2015 (2) dt.28-09-2015 petitioner is named in the FIR.
Considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner and the same is rejected. Anyhow, if the petitioner surrenders in the court below within a period of four weeks and pray for regular bail, same shall be considered by the court below on its own merit without being prejudiced by this order of rejection.
