Petitioner is languishing in custody since 03.09.2016 in connection with Chandauti P.S. Case No. 253 of 2016 for offences punishable under Sections 395, 397, 412 and 120(B) of the Indian Penal Code.

Co-accused Deepak Kumar had love affairs with the daughter of the informant. Deepak Kumar wanted to marry with the daughter of the informant and when he was unsuccessful in his design, he along with his criminal associates committed robbery in the house of the informant. Two persons including the petitioner were arrested at the spot.

Submission of the petitioner is that just to pressurize Deepak Kumar and his friends including the petitioner

Patna High Court Cr.Misc. No.51827 of 2016 (2) dt.30-11-2016 2/2 to not to marry with the daughter of the informant, the present false case has been lodged. This is not a case of dacoity as motive for alleged dacoity is non-execution of love affairs. Petitioner has stated on oath in paragraph 3 of the petition that he has got no criminal antecedent.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/Successor Court in connection with Chandauti P.S. Case No. 253 of 2016.
