The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 28.03.2016 passed in Cr. Misc. No. 4113 of 2016, on the ground that the petitioner is suffering in custody since 14.11.2015, up-till-now trial has not been concluded and in near future it is not likely to be concluded. The name of the petitioner has transpired in the confessional statement of co-accused Prabhash Kumar Yadav and in the statement of witness Kusheshwar Mandal vide paragraph 8 of the case diary. There is no chance of tampering with prosecution evidence and as such the petitioner deserves sympathetic consideration as there is no allegation against him to which the learned APP opposes by submitting that the petitioner has also
Patna High Court Cr.Misc. No.41214 of 2016 (3) dt.09-11-2016 been identified by the witness Kusheshwar Mandal during investigation at the time of committing murder. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected in S. Tr. No. 34 of 2016 pending in the court of learned Sessions Judge, Madhepura.
However, let the trial be expedited and concluded as early as possible, preferably within six months from the date of receipt/production of a copy of this order (Jitendra Mohan Sharma, J) avin/- U T
