====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 11-12-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in Katihar Town (Sahayak) P.S. Case No. 459 of 2018 instituted for the offence under Section(s) 394 and 397 Indian Penal Code.

Counsel for the petitioner submits that First Information Report is against unknown. There is no recovery of any incriminating articles from possession of the petitioner. No Test Identification Parade has been held. The petitioner has been implicated in the instant case on the basis of confessional statement of co-accused Kundan Mishra.

It is mentioned in paragraph-3 of the bail petition that other cases are pending against the petitioner but he is on bail on

Patna High Court Cr.Misc. No.74057 of 2018(2) dt.11-12-2018 2/2 all those cases.

Petitioner is in custody since 16.7.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Katihar Town (Sahayak) P.S. Case No. 459 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) S.Ali/- U T
