Petitioner seeks bail in Bhabua (Sonhan) P.S. Case No. 618 of 2018 registered under Sections 147, 148, 149, 341, 323, 324 and 307 of the I.P.C.
The accusation is that on 27.08.2018 wife of Babulal was engaged in constructing Pakka house at the barren land, at that time this petitioner along with other co-accused came there and started to abuse the informant and when the informant made protest to do so the petitioner gave Ballam blow to the informant causing injury on his stomach.
Learned counsel for the petitioner submits that while allegation has been made against the petitioner to cause Ballam injury at the stomach of the informant but out of three injuries
Patna High Court CR. MISC. No.23279 of 2019(2) dt.11-04-2019 2/2 one injury is at lumbar region 2"x 1 1⁄2" deep lacerated wound, other injury is between right thumb and right index finger 1⁄2"x 1/2" inch deep lacerated wound and whole body pain. The petitioner having no criminal antecedent is in custody since 05.02.2019.
Further submission is that, in fact, in the occurrence of mar-peet petitioner's side also received injuries for which Bhabua (Sonhan) P.S. Case No. 621 of 2018 was instituted on the basis of Fardbeyan of Dharmshila Devi wife of co-accused Babulal Bind.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount to the satisfaction of C.J.M., Kaimur at Bhabua, in Bhabua P.S.
