1. The learned counsel for the respondent-State seeks to file a counter affidavit on behalf of Chief Secretary to the Government of Bihar, Patna, wherein it has been stated that a notification dated 19.07.2024 has already been issued by the Urban Development and Housing Department and the post of competent authority of the Bihar State Housing Board, Patna has now been filled.

2. In view of the aforesaid, the learned counsel for the petitioner submits that the competent authority be directed to decide the case of the petitioner i.e. Eviction Case No.33 of

Patna High Court CWJC No.7210 of 2023(6) dt.23-07-2024 2/2 2023, expeditiously.

3. Having regard to the facts and circumstances of the case, this Court is satisfied that since now the competent authority of the respondent-Bihar State Housing Board, Patna has already been appointed, no further orders are required to be passed in the present case, however, the competent authority is directed to finally decide the aforesaid Eviction Case No.33 of 2023, by passing the final order, in accordance with law, within a period of three months of receipt/production of a copy of this order.

4. The writ petition stands disposed off on the aforesaid terms.
