The petitioner, who is in custody since 30.01.2020 and is a person of clean antecedents, seeks bail in connection with Nawada P. S. Case No. 93 of 2020 dated 29.01.2020 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears that on secret information, an Innova vehicle and a Pick-up Van were intercepted. The petitioner was found to be driving the Pick-up Van. 1500 litres of liquor is said to have recovered from the aforesaid vehicle. The learned counsel for the petitioner submits that he is the driver of Pick-up van and works for his master on
Patna High Court CR. MISC. No.19696 of 2020(2) dt.26-06-2020 2/2 monthly salary. He had no idea that the aforesaid consignment was kept in the vehicle.
Regard being had to the clean antecedents of the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd cum Special Judge, Excise Act, Nawada in connection with Nawada P. S. Case No. 93 of 2020. The petition stands allowed.
