Petitioner, who is in custody, seeks bail in connection with Turkauliya P.S. Case No. 419 of 2018 (G.R. No. 4554 of 2018) registered for the offences punishable under Sections 272 and 273/34 of the Indian Penal Code and under Sections 30(a)/38(1), 41(1) of Bihar Excise Act, 2016. Informant has stated that on secret information he raided the place and recovered 400 liters of spirit. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has falsely been implicated in this case. Nothing has been recovered from his possession. He was not apprehended at the place of

Patna High Court Cr.Misc. No.68291 of 2018(2) dt.29-11-2018 2/2 occurrence. It has been further submitted that similarly placed co-accused Ajay Rai has been granted bail by co-ordinate Bench of this Court in Cr. Misc. No. 67274 of 2018 vide order dated 22.11.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Motihari in connection with Turkauliya P.S.
