The petitioner apprehends his arrest in Naubatpur P.S. case No. 250 of 2018 registered under Section 363, 366(A) of the IPC.

The father of the victim disclosed that petitioner was imparting tuition to his daughter. On 25.05.2018 the petitioner came to his house to impart tuition and immediately thereafter his daughter left her house to meet the petitioner but she did not return. On search, the informant came to know that petitioner enticed away his daughter for the purpose of marriage. The learned counsel for the petitioner submits that the informant disclosed that his daughter was minor on the date of occurrence but the victim made her statement u/s 164 of the Cr. P. C. before the court. She disclosed that she voluntarily left her

Patna High Court CR. MISC. No.20162 of 2019(2) dt.02-04-2019 2/2 house and solemnized marriage with the petitioner. She is living with petitioner as husband and wife. The court assessed the age of victim to be 20 years. The victim also disclosed her age as 19 years.

Taking into consideration the fact that victim herself denied the factum of her kidnapping and she disclosed that she voluntarily left her house and solemnized marriage with petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur, Patna in connection with Naubatpur P.S. case No. 250 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
