The matter has been taken up through video conferencing.

The petitioner seeks bail in Madhuban P.S. case No. 147/2019 registered u/s 307and some other Sections of the IPC and u/s 3⁄4 of Prevention of Witch (Dain) Practices Act. The informant alleged that petitioner along with other accused persons entered into the house of informant and began to abuse the wife of the informant. The petitioner is alleged to have assaulted the informant with Fasuli.

The learned counsel for the petitioner submits that there is counter version being Madhuban P.S. case No. 148/2019. From the perusal of order sheet of learned Sessions Judge it would appear that four persons from the side of

Patna High Court CR. MISC. No.19701 of 2020(2) dt.24-06-2020 2/2 informant sustained injuries. The petitioner and others have also got injuries. The injuries found on the persons of injured are simple in nature. The petitioner is in custody since 23.01.2020. The learned APP, however, opposed the prayer for bail.

Perused the FIR. The petitioner is alleged to have assaulted the informant with sickle. Four persons are found injured from the side of informant but petitioner and others have also got injuries and the petitioner has remained in jail for about five months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Madhuban P.S. case No. 147/2019.
