JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-01-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner apprehends his arrest in Lodipur P.S. Case No.99 of 2020, registered for the offence punishable under Section 7 of the Essential Commodities Act.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner is the owner of the vehicle from which 9.5 quintals of rice has been recovered. It is further submitted that no case is made out under Section 7 of the E.C. Act. The petitioner has no PDS shop. It is also submitted that the petitioner has got no criminal antecedent as stated in para 3 of the bail application.
Having considered the facts aforesaid, let petitioner,
Patna High Court CR. MISC. No.30099 of 2021(2) dt.04-01-2022 2/2 above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Lodipur P.S. Case No.99 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
