JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-47(a) of the Bihar Excise (Amendment) Act, 2016. Seventeen bottles of Indian made foreign liquor were recovered from a bus and the petitioner was found sitting on the seat of the aforesaid bus from where, the alleged recovery was made. The petitioner is languishing in jail custody since 03-082016 and submission on behalf of petitioner is that the petitioner does not have any concern with the seized liquor and as a matter of fact, he was caught by the Excise Official on mere suspicion. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.
