JUSTICE SANJAY PRIYA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Chousa P.S. Case No. 54 of 2014 instituted for the offence under Sections 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner after getting appointment letter by the authority concerned did his duty for several months in Dhuria Kalason Chousa Middle School, but he has not taken a single farthing from the Government. It has further been submitted that the other coaccused has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 13.2.2017 passed in Cr. Misc. 4306 of 2017.

In such circumstances, prayer for anticipatory bail of

Patna High Court Cr.Misc. No.10756 of 2017 (2) dt.20-03-2017 2/2 the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Chousa P.S. Case No. 54 of 2014, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ashok Kumar II, learned Judicial Magistrate, 1st Class, Udakishunganj at Madhepura, subject to the conditions as laid down under Section 438 (2) Cr. P.C. It is made clear that the court below shall seek a report from the concerned school as to whether the petitioner has taken the money for the period he worked on the basis of the appointment letter annexed with the First Information Report, and in the event it is found that the petitioner has received remuneration, then the court below will be at liberty to take appropriate step for cancellation of bail of the petitioner.
