NILU AGRAWAL ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner seeks bail in connection with GRP Case No. 221 of 2016 registered for the offence punishable under Sections 366A, 511 of the Indian Penal Code.

The prosecution case as lodged by the informant is that she was working as Dancer and came to Patna along with the petitioner and the petitioner tried to induce her to stay in a Hotel in the pretext of marriage and tired to drag her from Patna Junction. After raising alarm the police came and got her saved. It has submitted by the learned counsel for the petitioner that he is innocent and has falsely been implicated in the aforesaid

Patna High Court Cr.Misc. No.54609 of 2016 (2) dt.23-12-2016 2/3 case and has no criminal history. It has further submitted that the petitioner has not committed any overt act and the allegations upon him is only on the basis of suspicion and he is in custody since 11.08.2016 and charge sheet has already been submitted against the petitioner hence there is no chance of tempering with the prosecution evidence.

However, learned A.P.P. for the State submits that petitioner is named in the FIR hence, opposes the prayer for bail. Be that as it may since the charge sheet has already been submitted and the material available does not reveal that the petitioner's release on bail would adversely effect his trial, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Patna in connection with GRP Case No. 221 of 2016 subject to the conditions that petitioner shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence and shall appear in the learned Court below, as and when directed and the default on two consecutive dates on his part without any reason shall disentitle
