1. Heard learned counsel for the petitioner and learned AC to GP-25 for the State.

2. The learned counsel appearing on behalf of the petitioner submits that in sum and substance the grievance of the petitioner as raised in the instant writ application is that the Circle Officer, Belaganj, Gaya issued Basgit Parcha dated 06.01.2009, of the raiyati land of the petitioner in favour of respondent no. 5. It is submitted that petitioner was completely unaware that the Circle Officer, Belaganj had issued Parcha of his raiyati land in favour of the respondent no. 5 in the year 2009, since no one from 2009 till 2023 came to take possession.

Patna High Court CWJC No.7481 of 2025(2) dt.17-07-2025 2/3 It is submitted that respondent no. 5 in the year 2024 came to take possession based on the Parcha, when the petitioner came to know about the said misdeed of the Circle Officer, Belaganj, as such, he filed Revision Case No. 01 of 2025 in the Court of Collector, Gaya against the order dated 06.01.2009 whereby Parcha was issued by the Circle Officer, Belaganj which is pending consideration.

3. The learned counsel for the petitioner submits that the petitioner would be satisfied in the event if the writ application is disposed of with a direction to the Collector, Gaya to consider and dispose of Revision Case No. 01 of 2025 within a time frame.

4. The learned counsel appearing on behalf of the State does not have any objection to the said submission made by the learned counsel appearing on behalf of the petitioner.

5. After hearing the learned counsel for the parties, the writ application is disposed of with a direction to the District Magistrate, Gaya to consider and dispose of Revision Case No. 01 of 2025 in accordance with law, after giving proper opportunity of hearing to all concerned within a period of four months from the date of receipt/production of a copy of this order.

6. At this stage, the learned counsel appearing on behalf of the petitioner submits that the respondent no. 5 based on the strength of Parcha has already cut the trees standing on the land and is in the process of starting construction of the house, on which the learned State counsel submits that the issue would be adjudicated by the Collector in the aforesaid revision case.
