JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 12.09.2016, in connection with Harnaut P.S. Case No. 250 of 2016, registered for offences punishable under Section 414/34 of Indian Penal Code. Allegation is of recovery of 60 bottles of royal stag whisky and 60 bottles of royal challenge whisky from the petitioner.

It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner. The only allegation that can be levelled against the petitioner is that after seeing the police, he tried to flee away. Petitioner has got no criminal antecedent and he has been languishing in judicial custody since 12.09.2016.

Considering the aforementioned facts and circumstances, nature of offence, the period of custody and also the fact that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, in connection with Harnaut P.S. Case No. 250 of 2016.
