Petitioner, who is in custody, seeks bail in connection with Rail Muzaffarpur P.S. Case No. 164 of 2018 registered for the offences punishable under Sections 420/34 of the Indian Penal Code, under Section 18(A)(1)/27D of Drugs and Cosmetics Act, 1940 Rules 65 (18) of Drugs & Cosmetic Rules and Section 22(b) of N.D.P.S Act, 1985 and under Section 7 of E.C. Act.

Informant who is a Drug Inspector has alleged that on 04.09.2018 one Julfikar Ali Ahmad was intercepted by Rail Police and recovered huge quantity of medicines including 40 tablets of Zapiz which conatins 0.5 mg Chlonazepam each which comes under N.D.P.S Act and on interrogation he disclosed that the said medicines belongs to Pramod Jha

Patna High Court Cr.Misc. No.66290 of 2018(2) dt.20-11-2018 2/2 (petitioner) who is a sales executive in Intas Pharmaceuticals Company.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. He was not arrested on the spot. Nothing incriminating material has been recovered from his possession. He has no concern with the said recovery. He has no criminal antecedent. He is in custody since 06.09.2018. It has been further submitted that similarly placed co-accused has been granted bail by another co-ordinate Bench of this Court in Cr. Misc. No. 67240 of 2018 vide order dated 06.11.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions-cum-Special Judge, Muzaffarpur in connection with Rail (N.D.P.S.) P.S. Case No. 164 of 2018.
