The petitioner apprehends his arrest in connection with Vidyapati Nagar P.S. Case No. 32 of 2016 registered under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Submission is that the petitioner is innocent and he has committed no offence. He has been falsely implicated in this case as there is no eye witness of the alleged occurrence. It has been submitted that the petitioner, at the relevant time, was at Patna and was not present at the place of occurrence.
Learned A.P.P. appearing on behalf of the State submits that now, charge sheet has been submitted in this case and
Patna High Court Cr.Misc. No.45233 of 2016 (11) dt.18-05-2017 2/2 the petitioner is absconder. It has also been submitted that the petitioner has criminal antecedent also.
Having considered the facts and circumstances of the case and the nature of allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer for anticipatory bail, in connection with Vidyapati Nagar P.S. Case No. 32 of 2016, pending in the court of learned J.M. 1st Class, Dalsingsarai, is rejected.
