Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Chandauti P.S. Case No. 254 of 2018 registered for offence punishable under sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

As per allegation, the appointment of Block Teachers were made on the basis of forged mark-sheets. The selected

Patna High Court CR. MISC. No.36082 of 2021(3) dt.25-07-2022 2/3 teachers were shown in high position in the merit list in comparison of those, who had secured more marks than the selected teachers. The allegation against the petitioner, who is Block Development Officer, is that being the member of Appointment Committee, he had also complicity in selection of undeserving candidate.

The learned counsel for the petitioner has submitted that in paragraph 7 of the bail petition, it has categorically been mentioned that the merit list was prepared in the year 2013 when the present petitioner was not member of Appointment Committee. He joined as Block Development Officer, Chandauti Block, as probationer on 30.06.2014 and it was his first posting.

It appears that the merit list, on the basis whereof selection was made, was prepared prior to the joining of the present petitioner. On similar footing, co-accused Sanjeev Kumar @ Sanjeet Kumar who was also Block Development Officer, has been granted anticipatory bail by the coordinate Bench.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to

No.36082 of 2021(3) dt.25-07-2022 3/3 be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya in connection with Chandauti P.S. Case No. 254 of 2018, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
