The petitioner has preferred this application for grant of regular bail in connection with Chhatauni P.S. Case No. 08 of 2023 dated 07.01.2023 registered for the offences punishable u/s 20(b) (ii)c/22 of N.D.P.S.

As per the prosecution case, the petitioner and the other co-accused persons boarded in a Scorpio were apprehended by the police during checking at Chhatauni Chowk. There were three persons in the said vehicle, namely Ravi Ranjan Singh, Suresh Yadav and the petitioner Bittu Kumar Singh. On search 100 gram smack

Patna High Court CR. MISC. No.23892 of 2023(2) dt.23-05-2023 2/2 and a mobile from the possession of the co-accused Suresh Yadav, two mobile phones from the possession of the co-accused Ravi Ranjan Singh and 3.5 kg Ganja from the possession of the petitioner were recovered.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The seized contraband is less than commercial quantity. The petitioner has got clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 08.01.2023. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran, Motihari in connection with Chhatauni P.S. Case No. 08 of 2023. The application stands allowed.
