JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 307 and other minor Sections of the Indian Penal Code. Petitioner appears to have misused the privilege of bail for near about 14 years.
No doubt, petitioner is in jail custody since 5.12.2015 but considering his previous conduct, I am not inclined to grant bail to him and accordingly, his prayer for bail in connection with Jehanabad P.S. Case No.175 of 2000 pending in the court of Additional Sessions Judge IV, Jehanabad stands rejected, at least, at this stage. However, if the trial of the petitioner is not concluded
Patna High Court Cr.Misc. No.33879 of 2016 (2) dt.18-08-2016 2/2 within six months from the date of receipt/production of a copy of this order, petitioner may renew his prayer for bail before the learned trial court itself.
