JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 447, 341, 323, 307, 337 and 504 of the Indian Penal Code and subsequently Section 302 of the Indian Penal Code has been added.

Allegation against the petitioner is that he assaulted the informant on his head and other family members. It has been submitted on behalf of the petitioner that he is in custody since 13.2.2016. Chargesheet has been submitted against the petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. There is specific allegation against the petitioner of causing injury upon the head of the informant by lathi. The said allegation is not corroborated by the injury report of the informant. There is no injury attributed against the petitioner for causing injury upon the deceased. In respect to the deceased, general and omnibus allegation have been against the petitioner. Specific injury has been attributed against one Manoj Paswan causing injury on the head of the deceased by Khanti.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Matihani P.S. Case no. 17 of 2016.
