JUSTICE SATYAVRAT VERMA ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 22.02.2022, he is a person with clean antecedent and prosecution report has been submitted in this case.

Allegation is of recovery of 59 litre of liquor from an auto.

The learned counsel for the petitioner submits that petitioner is the driver and as such, was not knowing which

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and prosecution report has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No.105 of 2022.

The application stands allowed.
