Petitioner is in jail custody since 30.6.2015 in a case registered under sections 302, 201/34 of the Indian Penal Code. Petitioner happens to be wife of the deceased and the informant claims that deceased had gone to parental home of the petitioner where he was killed by the petitioner and her other family members. The dead body of the deceased was recovered from a canal after 20 days of alleged occurrence.

Informant claims about the hands of the petitioner and her other family members in the crime on the ground that relation of deceased was strained with the petitioner.

Admittedly, none has seen the actual killing of the deceased and having more or less similar allegation co-accused Pramod Ram has already been granted privilege of bail by a coordinate bench of

Patna High Court Cr.Misc. No.38442 of 2016 (2) dt.16-09-2016 this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Motihari in Adapur (Harpur) P.S. Case no. 58/2014. shahid (Hemant Kumar Srivastava,J) U T
