(3) Kundan Singh (4) Umraon Prasad Nirmal who apprehends their arrest in Rajgir P.S. Case No.119 of 2015 registered for the offence punishable under Sections 147, 148, 149, 332, 353, 307, 423, 435, 333 IPC and Section 27 of the Arms Act read with Section 3⁄4 Prevention of Public Property Act. Heard the learned A.P.P. for the State also.
According to the prosecution case, about 400-500 persons making unlawful assembly surrounded the police station and pelted stones as a result of which many of the police party
Patna High Court Cr.Misc. No.41575 of 2015 (2) dt.08-10-2015 2/2 received injuries. Amongst the mob, someone fired at the police party causing gun shot injury. At the spot, 17 persons were caught and the petitioners were mentioned in the F.I.R. The learned counsel for the petitioners submitted that there is no allegation against these petitioners that he fired at the mob. The allegation is in general against all the 400-500 persons. Considering the nature of allegation, I direct that all the petitioners, named above, to surrender before the Court below within six weeks from today and on their so surrendering, the Court below is directed to release them on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No.119 of 2015, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Mungeshwar Sahoo, J) Sanjeev/- U
