JUSTICE SUDHIR SINGH ORAL ORDER 11-01-2017 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Maker P.S. case No.30 of 2013 instituted for the offence under Sections 302 and 201/34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Saran at Chapra.

Earlier the bail application of the petitioner was rejected vide Annexure-2 to the present application.

A report was called for from the Trial Court. The same is at Flag 'A'. It has been reported that all the prosecution witnesses have been examined except the informant and the Investigating Officer. The trial is expected to be concluded within a period of three months.

Considering the aforesaid facts and circumstances, I am

Patna High Court Cr.Misc. No.50697 of 2016 (3) dt.11-01-2017 2/2 not inclined to grant bail to the petitioner at this stage. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial within a period of three months from the date of receipt/production of a copy of this order.

The District Magistrate, Saran at Chapra and the Superintendent of Police, Saran at Chapra are also directed to ensure that the official witnesses are produced on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.

Let this order be communicated to the District Magistrate, Saran at Chapra and the Superintendent of Police, Saran at Chapra.
