The petitioners apprehend their arrest in Gopalganj Mahila P.S. Case No. 50 of 2016 registered for the offences punishable under Sections 498A, 494/34 of the Indian Penal Code and under Sections 3/4 of the Dowry Prohibition Act. The informant, wife of Prameshwar Kumar Verma, named the petitioners along with her husband and alleged that all the accused persons assaulted her and, drove her out from the house while she was pregnant. She gave birth to a male child but she came to know that her husband solemnized second marriage for getting dowry.
Patna High Court Cr.Misc. No.18171 of 2017 (2) dt.16-05-2017 2/2 Learned counsel for the petitioners submits that the petitioners are father-in-law, mother-in-law, brother-in-law and unmarried sister-in-law of the informant. No specific allegation of demand of dowry and assault is made against the petitioners. Considering the nature of allegations made against the petitioners and the petitioners are in-laws of the informant, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Gopalganj Mahila P.S. Case No. 50 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
