JUSTICE ARUN KUMAR ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 30(A)/41(A) of the Bihar Excise (Amendment) Act, 1916. Allegation in brief against the petitioner is that he was carrying a gunny bag containing 32 bottles of Nepali Saufi liquor each containing 300 ml was recovered from his possession. Learned counsel appearing on behalf of the petitioner submits that he was passenger in the Auto and the same was not recovered from his conscious possession. Moreover, the petitioner has no criminal antecedent of any nature and is languishing in jail custody since 22.10.2016.
Considering the volume of liquor as well as period of

No.534 of 2017 (2) dt.11-01-2017 2/2 custody and clean antecedent of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S.
