JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2018 The petitioners seek regular bail in connection with Sasaram Rail P.S. Case No. 71 of 2018, registered for offences punishable under Section 399/402 of the Indian Penal Code. Police on information of assemblage of some miscreants for preparation to commit dacoity, proceeded to platform no. 3 and 4 of Sasaram Railway Station, where, he found 15-20 young persons in suspicious condition. Sixteen persons were arrested and on search, certain articles such as blade, knife and screw drivers were recovered. It has been submitted on behalf of the petitioners that they have been made accused in this case only on the basis of
Patna High Court Cr.Misc. No.66790 of 2018(2) dt.26-11-2018 2/2 suspicion. Further petitioners have no criminal antecedent and have been in judicial custody since 14.07.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Gaya, in connection with Sasaram Rail P.S. Case No. 71 of 2018, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
