The present writ petition has been filed seeking the following relief:- "(i) For quashing of letter dated 21-12-2017 contained in Memo No. 3993 (Article of charges) issued under the signature of respondent District Education Officer, East Champaran, Motihari including the entire disciplinary proceeding as initiated against the petitioner without following the due procedures as laid down which vitiates whole procedures."

At the outset, the learned counsel for the respondent-State has submitted, by referring to paragraph no.9

Patna High Court CWJC No.5991 of 2022(2) dt.29-11-2023 2/2 of the counter affidavit filed in the present case that not only suspension of the petitioner has stood revoked, but the departmental proceeding has also been dropped, hence the present writ petition has been rendered infructuous. 3.

The aforesaid factual fact has though not been disputed by the learned counsel for the petitioner, but the learned counsel for the petitioner seeks liberty on behalf of the petitioner to agitate his subsisting grievance, if any, in accordance with law. Liberty so sought is granted.

Accordingly, the present writ petition stands disposed off as not pressed.
