This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Dariyapur PS Case No. 412 of 2018 for the alleged offence punishable under Sections 25(1-b)a/26/35 of the Arms Act. Allegation against the petitioner in the instant case is that he was one of the miscreants and on search one loaded country-made pistol was recovered. Learned counsel representing the petitioner submits that petitioner has no criminal antecedent. He further submits that similarly circumstanced co-accused persons have been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 567 of 2019 vide Annexure-3. Petitioner is in custody since 17.12.2018.

No.19227 of 2019(2) dt.29-03-2019 2/2 Considering the fact that petitioner has no criminal antecedent, he has remained in custody since 17.12.2018, and similarly placed co-accused have already been granted bail, this application is allowed. Accordingly, let the petitioner abovenamed, be enlarged on bail on furnishing bail bond of Rs.10,000/ (Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-IV, Saran in connection with Dariyapur PS Case No. 412 of 2018.
