Petitioner apprehends his arrest in connection with Excise Case No. 149 of 2016 registered for the offence under Sections- 47A of the Indian Penal Code.

Learned counsel for the petitioner submits that for the same occurrence informant lodged another case as Majhauliya P.S. Case No. 149 of 2016. Petitioner has been granted bail by this Hon'ble Court in the aforesaid case. Nothing has been recovered from the conscious possession of the petitioner.

Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or

Patna High Court Cr.Misc. No.13026 of 2017 (3) dt.19-05-2017 2/2 surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Excise Case No. 149 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
