The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 279, 337, 341, 323, 504, 342, 427/34 of the Indian Penal Code and 3(1)(x)(xi) of SC/ST (Prevention of Atrocities) Act.

The accusation is of making assault and abusing by calling caste name.

It is submitted by learned counsel for the petitioners that the injuries have been found to be simple and for

Patna High Court Cr.Misc. No.39915 of 2015 (2) dt.05-10-2015 2/2 a petty dispute the accusation has been levelled. For the occurrence of 20.07.2014 at 7.30 A.M. morning the FIR was registered on 21.07.2014 at 2.30 P.M.

Considering the nature of accusation and the fact that the investigation has already concluded coupled with the fact that a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent, it is a case for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Korha P.S. Case No. 124 of 2014 pending in the court of learned Chief Judicial Magistrate, Katihar.

With the aforesaid observation, this application is disposed of.
