The petitioner seeks regular bail in Balia P.S. Case No. 73/2018, registered for the offences punishable under Sections 382, 393, 411 and 34 of the Indian Penal Code and section 27(2) of the Arms Act.

Learned counsel for the petitioner has submitted that he has falsely been implicated in this case. He is Khalasi and there was dispute with regard to payment of dues amount. In the written report, there is specific allegation against accused persons namely, Shiv Kumar and Sanaullah. It is also alleged that Shiv Kumar put pistol on the informant and gave threat to kill. Other two accused caught hold the informant and Sanaullah attempted to inject narcotic substance to the informant. The

Patna High Court Cr.Misc. No.71033 of 2018(2) dt.10-12-2018 2/2 vehicle was being driven by Shiv Kumar. Thereafter, informant raised hulla. The villagers arrived there and three persons namely, Sanoj Kumar, Shiv Kumar and Md. Sanaullah managed to flee away and this petitioner was apprehended. Seizure list is the part of F.I.R. which shows there is no recovery from possession of the petitioner. Seizure list does not bear signature of the petitioner. He is in custody since 23.03.2018 having clean antecedent.

Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Balia P.S. Case No. 73/2018, subject to the condition that both the bailors will be close relative of the petitioner.
