The petitioner prays for anticipatory bail in connection with Gaya Rail PS case no. 191 of 2016 registered for the offences punishable under Sections 147, 148, 149, 353, 341, 232, 384, 307, 324, 504 of the Indian Penal Code, Sec. 27 of Arms Act and Sections 145 and 147 of Railways Act. It has been submitted on behalf of petitioner that except that the petitioner is named in FIR, there is no specific allegation against the petitioner.

Having heard both sides and in view of the fact that there is no specific allegation against petitioner, let the
Patna High Court Cr.Misc. No.52065 of 2016 (2) dt.21-12-2016 2/2 abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Gaya in connection with Gaya Rail PS case no. 191 of 2016 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that he must cooperate in the investigation of the case.
