Petitioners seek bail in Madhubani (Town) P.S. Case No.308/2018 (CRI Case No.1764/2018) registered for the offences punishable under Sections420, 467, 468 and 471/34 of the Indian Penal Code.
Informant is the Circle Officer who in his written complaint has alleged that he received a complaint about the concerned NGO and found that the petitioners were working there and on inquiry it was found that they were depositing the documents for grant of Pradhan Mantri Mudra Loan by the aspirants although they were not authorized to do so nor they could produce any document for which they have been

No.68931 of 2018(2) dt.04-12-2018 2/3 authorized for collecting said documents for grant of Pradhan Mantri Mudra Loan and they were charging Rs.1,000/- from every aspirants for grant of loan and, as such, were committing forgery. On such allegations, they were arrested. It has been submitted on behalf of the petitioners that they are only the employees of the NGO and they are performing their duty on the direction of the Secretary and the President of the NGO. Petitioners have no criminal antecedent and they are in custody since 31.08.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Madhubani (Town) P.S. Case No. 308/2018 (CRI Case No.1764/2018) with following conditions:-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioners shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
