This application is for grant of regular bail in connection with Mushari P.S.Case No.250 of 2018 dated 29.10.2018 for the offences under Sections 363, 365, 366A, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per FIR is that two miscreants entered inside the house of the informant, kidnapped the minor daughter of the informant and on protest they fired on the informant causing injury and later on the girl was recovered and she made statement under Section 164 Cr.P.C. and named the petitioner also.

Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against them and there are some contradictions between the

Patna High Court CR. MISC. No.19140 of 2019(3) dt.21-05-2019 2/2 statement recorded under Section 164 Cr.P.C. and Section 161 Cr.P.C. and further submission is that he is in custody since 16.11.2018.

Heard learned A.P.P. , who has opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

With the above direction, this application is dismissed.
