The petitioner prays for bail in Makhdumpur P.S. Case No. 199 of 2016, registered under Sections 420, 311, 34 of the IPC. The Sub Inspector of Police lodged the case that the three accused persons including the petitioner was apprehended with several A.T.M., cards PAN cards, and driving license along with mobile phones. It is stated that co-accused Bikky Kumar has been granted bail by this court vide order dated 06.10.2016, passed in 42537 of 2016. Petitioner is accused of a criminal case of minor nature in which he has been granted bail. It is further, submitted that after the institution of the present case, the petitioner has not been made accused and remanded in any other criminal case based on the investigation report of the present case. He is in custody since 6.8.2016.

The court below shall verify the statement with regard to the

Patna High Court Cr.Misc. No.48075 of 2016 (2) dt.25-11-2016 2/2 non remand of the petitioner in any other case after the present one and if it is found that the statement made at bar is correct the petitioner, above, named shall be released on bail on his arrest or surrender within four weeks on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad, in Makhdumpur P.S. Case No. 199 of 2016 subject to the following conditions: (i) One of the bailors shall be the own/close family members of the petitioner.

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the court below. In case of default in doing so on two consecutives occasions without any cogent/satisfactory reason(s), the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
