2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.
3. As per the prosecution case, all the F.I.R named accused persons including this petitioner armed with iron rod and bat assaulted the informant in which he sustained injury on the spiral region.
4. It is submitted by the learned counsel for the petitioner that there is general and omnibus allegation of assault against the petitioner. No specific overt act is alleged against the petitioner. He next submits that on the day of occurrence the

No.25188 of 2023(3) dt.13-07-2023 2/2 petitioner was not there rather he was in Durgapur, West Bengal for pursing his study in Rajendra Nath College of Polytechnic but due to dirty village politics, his name has been dragged in this case. Similarly situated co-accused persons have already granted bail by this Court vide order dated 28.04.2023 in Cr. Misc. No. 15911 of 2023. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Brahampur P.S. case no 776 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
