2. The petitioners are custody in a case registered for the offence punishable under Sections 379, 413 and 414/34 of the Indian Penal Code.
3. As per allegation in the FIR, it is a case of theft of 20 cycles and 15 bi-cycles by the accused persons including the petitioners.
4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He next submits that the petitioners have no concern with the alleged theft of the stolen items and the scrap shop does not belong to
Patna High Court CR. MISC. No.31784 of 2024(3) dt.31-07-2024 2/2 this petitioners and petitioners have got clean antecedent as stated in para-3 of the petition and they are in custody since 23.12.2023.
5. Learned APP for the State opposes the prayer for bail of the petitioners.
6. Considering the aforesaid facts and circumstances of the case and period of custody of the petitioners, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-I, Gaya in connection with Civil Lines P.S. Case No. 768 of 2023 with condition that the petitioners shall physically appear before the trial court till conclusion of proceeding of the trial. (Ramesh Chand Malviya, J) Brajesh Kumar/- U T
